What is the Party Wall Act?
The Party Wall Act covers three types of work – alterations to a shared wall, construction of new boundary walls and excavation work close to neighbouring properties. The Act is often not part of the planning process but this can lead to serious issues as it is a legal requirement to factor it into plans. If there are disputes under it, work can be stopped and there can be spurious claims.
Under the Act, a building owner has to serve notice and obtain the affected adjoining owner’s consent for the work. If this isn’t provided, it is viewed as being ‘in dispute’ and a surveyor is appointed to resolve the issues.
